These Terms & Conditions govern the use of the Boriant Group website and the provision of services by Boriant Group.
Boriant Group is a private concierge and lifestyle service operated by an independent professional established in Spain. The legal identity and contact details of the service provider are set out in the Boriant Group Legal Notice.
By using this website, submitting an enquiry, or requesting services from Boriant Group, you acknowledge and agree to these Terms & Conditions.
1. Nature of Boriant Group
Boriant Group provides private concierge, lifestyle assistance, personal assistance, sourcing, local advisory, introductions, access and coordination services.
Our role may include researching options, identifying suitable providers, making introductions, communicating with independent professionals or suppliers, assisting with individual arrangements, and coordinating requests according to the client’s instructions.
Boriant Group does not itself provide every underlying product or professional service that may be requested by a client.
Where a request involves an independent provider, that provider remains responsible for the underlying product or service and the applicable arrangement is subject to that provider’s own terms and conditions.
2. Independent Providers
Boriant Group may recommend, introduce, source or coordinate access to independent providers according to a client’s request.
These may include transportation providers, hotels and accommodation providers, private aviation companies, helicopters, chauffeurs, personal assistants, advisors, health and wellness professionals, beauty professionals, dental specialists, real-estate professionals, retailers, private clubs and other independent businesses or individuals.
Where Boriant Group recommends or introduces a provider, the client is responsible for deciding whether to engage that provider.
The underlying contract for any third-party product or service is between the client and the relevant provider unless expressly agreed otherwise.
The provider’s own terms, pricing, availability, cancellation policies, refund policies, deposits and other conditions apply to the underlying service.
Boriant Group may use reasonable care in selecting or recommending providers based on our knowledge and experience, but does not guarantee the performance, availability or suitability of any independent provider.
3. Hotels & Accommodation Recommendations
Boriant Group may recommend hotels, villas or other accommodation based on our local knowledge, experience and familiarity with particular properties or providers.
Recommendations are provided as part of our concierge service.
The client makes the accommodation reservation directly with the relevant hotel, villa or accommodation provider and is responsible for payment, identification, cancellation, amendments, deposits and compliance with the provider’s terms and conditions.
Boriant Group does not book accommodation on behalf of clients and does not receive or hold accommodation payments on their behalf.
Any accommodation recommendation is based on information reasonably available to Boriant Group and does not constitute a guarantee regarding the quality, availability, pricing or suitability of the property.
4. Private Aviation
Boriant Group may assist clients in identifying and connecting with selected private aviation companies, brokers or operators.
Our role may include making an introduction, communicating the client’s general requirements or assisting with initial coordination.
The client contracts directly with the relevant aviation provider and pays that provider directly.
Boriant Group does not operate aircraft, provide aviation services, sell flight tickets or act as the carrier or operator of any aircraft.
The aviation provider is responsible for the aircraft, crew, licensing, insurance, safety, operation, pricing, availability, cancellation conditions and performance of the aviation service.
Any aviation arrangement is subject to the provider’s own terms and requirements.
5. Private Cars, Chauffeurs & Helicopters
Boriant Group may assist with individual private transportation requests, including chauffeur services, luxury vehicles, private cars and helicopter services.
Such services are supplied by independent transportation providers.
Where a provider requires identification, driving credentials, payment details, a security deposit, card authorisation, insurance excess or another form of guarantee, these requirements must be satisfied by the client directly in accordance with the provider’s terms.
Boriant Group does not provide, advance or guarantee any vehicle rental deposit, security deposit, damage deposit, insurance excess or other financial guarantee required by a transportation provider.
The client is responsible for charges arising under the provider’s agreement, including damage, loss, traffic violations, fines, excess mileage, fuel, insurance excesses, late returns and other applicable charges.
Boriant Group does not own, operate or insure the vehicles or helicopters supplied by independent providers.
6. Travel & Personal Accompaniment
Boriant Group does not book commercial flights or accommodation for clients and does not organise travel packages or holidays.
Boriant Group may, however, provide personal assistance, local knowledge and discreet accompaniment to clients who are travelling independently.
This may include assistance with local requests, recommendations, introductions, transportation and other individual needs during a client’s stay.
Any travel arrangements made independently by the client remain the responsibility of the client and the relevant provider.
7. Specialist, Advisor & Assistant Travel
Boriant Group may facilitate services provided by independent specialists, advisors, personal assistants and other professionals who travel to the client.
Where necessary to provide the requested service, Boriant Group may arrange or pay for travel, accommodation or other logistical requirements for the independent professional.
Such arrangements are made for the purpose of enabling the independent professional to provide their requested service to the client.
The professional remains an independent provider and is responsible for the professional service itself.
The client is responsible for the agreed cost of the professional’s service and, where applicable, any agreed costs associated with bringing the professional to the client’s location.
8. Health, Wellness & Beauty Services
Boriant Group does not itself provide medical, psychological, dental, physiotherapy, aesthetic, beauty or other regulated professional services.
Boriant Group may identify, recommend, introduce and coordinate access to independent qualified professionals in these areas.
These may include physiotherapists, psychotherapists, doctors, dental specialists, beauty professionals, aesthetic specialists, wellness practitioners and retreat providers.
Where a professional offers FMTY (“Fly Me To You”) services, Boriant Group may assist with arranging the professional’s travel to the client’s requested location.
The relevant professional is solely responsible for their qualifications, licensing, professional advice, treatment, conduct, suitability and results.
Boriant Group does not guarantee any medical, therapeutic, aesthetic or wellness outcome.
Clients should obtain independent professional advice regarding the suitability of any professional service for their circumstances.
9. Real Estate Advisory
Boriant Group may provide local knowledge, research and introductions relating to residential or investment property.
This may include identifying areas, researching properties of potential interest and introducing clients to relevant local professionals.
Boriant Group does not act as a real-estate agent, broker, lawyer, surveyor, financial adviser, tax adviser or investment adviser unless expressly stated otherwise.
Any property transaction is entered into directly between the client and the relevant seller, owner, agent or other third party.
Clients should obtain independent legal, financial, tax and technical advice before entering into a property transaction.
10. Shopping & Sourcing
Boriant Group may assist with personal shopping, gifting, sourcing and identifying specific or hard-to-find goods.
Where goods are supplied by a third party, the purchase is subject to the relevant supplier’s terms and conditions.
The supplier remains responsible for the goods, including their quality, condition, authenticity, availability, delivery, returns and warranties, where applicable.
Boriant Group may assist with communication and coordination where appropriate.
11. Private Clubs & Access
Boriant Group may assist with access to private clubs, VIP tables, preferred venues and other establishments.
Any access, reservation or admission remains subject to the relevant venue’s availability and conditions.
Boriant Group does not guarantee admission, preferred seating, continued membership, access or availability where such matters are controlled by the relevant venue or provider.
Where a deposit or payment is required, the client remains responsible for any such amount and for any cancellation or non-attendance charges imposed by the venue.
12. Personal Assistance & Special Requests
Boriant Group may provide personal assistance with practical, lifestyle and bespoke requests.
Some requests may require the involvement of independent professionals, suppliers or other third parties.
Boriant Group may research options, make introductions, communicate with providers or coordinate individual elements of a request where appropriate.
Boriant Group does not guarantee that every request can be fulfilled.
We reserve the right to decline requests that are unlawful, impractical, unavailable, inappropriate or inconsistent with our service standards.
13. Payments Made on Behalf of Professionals
Where expressly authorised and agreed with the client, Boriant Group may make payments relating to the travel, accommodation or other logistical requirements of an independent specialist, advisor, assistant or professional who is travelling to the client.
Such payments are made in connection with the professional service being provided to the client.
The client remains responsible for any agreed amounts payable to Boriant Group in relation to those costs.
Boriant Group does not generally make payments to hotels, private aviation companies or other travel providers on behalf of clients.
Where the client independently engages such a provider, the client pays the provider directly.
14. Boriant Group Fees
Fees for Boriant Group’s own services will be communicated to the client before the relevant service is provided where applicable.
Third-party costs are separate unless expressly stated otherwise.
Where a fee or commission is payable to Boriant Group, the applicable amount or basis of calculation will be communicated to the client as appropriate.
Third-party prices and charges are determined by the relevant provider.
15. Cancellations and Changes
Where an arrangement involves an independent third-party provider, cancellation, amendment and refund policies are determined by that provider.
Boriant Group cannot guarantee that a provider will permit cancellation, amendment, refund or an exception to its conditions.
Where Boriant Group has already carried out work on a client’s request, any applicable Boriant Group service fee may remain payable even if the underlying third-party arrangement is subsequently cancelled.
The client remains responsible for third-party cancellation fees, deposits, penalties or other charges.
16. Client Responsibilities
Clients are responsible for providing accurate and complete information required to fulfil their requests.
This may include names, contact details, dates, identification information, preferences, medical or professional information where voluntarily and appropriately provided, and other information necessary for a particular request.
Clients are responsible for reviewing important details before confirming any arrangement, particularly names, dates, prices, provider terms and cancellation conditions.
Boriant Group is not responsible for consequences arising from information supplied by a client that is incomplete, incorrect, inaccurate, delayed or not received.
17. Third-Party Liability
Boriant Group will use reasonable care and skill in providing the concierge services it has expressly agreed to provide.
Where goods or services are supplied by an independent third party, Boriant Group is not responsible for the acts, omissions, performance, delays, cancellations, changes, availability, quality, safety or failure of that third party, except to the extent that such liability cannot lawfully be excluded.
The client’s contract for the underlying goods or services is with the relevant provider.
Boriant Group may, where reasonably possible, assist the client in communicating with the provider or addressing an issue.
Nothing in these Terms & Conditions excludes or limits liability that cannot lawfully be excluded or limited.
18. Recommendations & Local Knowledge
Boriant Group may provide recommendations based on local knowledge, experience, professional relationships and information available to us.
Recommendations do not constitute a guarantee or warranty regarding the performance, quality, suitability or availability of the recommended provider or service.
The client remains responsible for deciding whether to engage a recommended provider.
19. Confidentiality & NDA
Boriant Group approaches client communications and requests with discretion and confidentiality.
Where a client requires additional contractual confidentiality, Boriant Group may enter into a separate Non-Disclosure Agreement upon request.
The Boriant Group Privacy Policy governs the handling of personal information submitted through the website and other communications.
20. Website Information
Information published on the Boriant Group website is provided for general informational purposes.
We aim to keep the website accurate and current but do not guarantee that every description, availability statement or other information will always be complete, accurate or current.
Information concerning independent providers may change without notice.
21. Prohibited Requests
Boriant Group will not knowingly facilitate requests that are unlawful, fraudulent, abusive, exploitative or otherwise prohibited by applicable law.
We reserve the right to refuse or discontinue assistance with any request that falls within these categories.
22. Force Majeure
Boriant Group will not be responsible for delay or failure to perform an obligation where such delay or failure results from circumstances beyond our reasonable control.
Such circumstances may include extreme weather, natural disasters, government actions, strikes, transportation disruption, communications failures, supplier failures or other extraordinary events.
23. Changes to These Terms
Boriant Group may update these Terms & Conditions from time to time to reflect changes to our services, website or legal obligations.
The latest version will be published on this page and will apply from the date indicated at the beginning of the document.
24. Applicable Law & Jurisdiction
These Terms & Conditions are governed by the laws applicable to the service provider’s establishment in Spain, without prejudice to any mandatory rights or protections that may apply under applicable law.
Nothing in these Terms & Conditions is intended to remove any mandatory consumer rights or protections.
Subject to applicable law, disputes arising in connection with these Terms & Conditions or the services provided by Boriant Group shall be submitted to the competent courts in Spain.
